A number of problems are confronting the schools of today. Many of these have reached the courts for guidance as to how to solve them. One of the
most pressing of these problems is extent of liability which exists for the educational inadequacies which result from inadequate teacher qualifications and training. Many teachers and administrators are being
retained out of concern for such federal laws as affirmative action. Many, however, are simply counterproductive in the impact they have on the educational system. The question arises,
therefore, as to whether or not employees and school districts can be held legally liable for the educational inadequacies which result from inadequate teacher qualifications and training has arisen, in
fact, in numerous cases which have reached the Supreme Court itself. One has to only casually peruse the educational system of this nation
to discern that the quality of our schools is declining. This decline is evident when reviewing nationalized test scores but also just in relying on the knowledge base individual
instructors have developed over the years. This decline, very simply put, is the result of too much political maneuvering in the school system. In the United States we
as citizens, however, have come to look to issues such as job security to justify our continued path in a system we know is failing. The expectation that the
school system is a political arena is one which has resulted in a school system which is far from satisfactory and one which is in dire need of change.
Educational reform is not only a need it is an imminent necessity. Hirsch (1998, PG) notes:
