and argues that they fit his alternative theory very well. Discussion Perhaps there is no legal argument as controversial as the insanity defense. Supporters of this defense argue that it
is morally repugnant to punish someone who is insane or was of unsound mind at the time he committed the crime of which he is accused. Opponents argue that theres
no real way to know if someone is insane or not or simply has fooled the "experts"; furthermore, there must be adequate punishment for heinous crimes such as serial murder.
Elliot Leyton steps into the middle of this controversy and argues against the "medical" explanation for serial murder, saying that by considering these crimes as a psychological phenomenon, we
limit our understanding, and our ability to prevent further such acts. He notes that in one sense, anyone who commits murder must be said to be insane, but that is
a moral judgment, not a scientific one. Instead of looking at these crimes in isolation, as the work of deranged individuals, Leyton says they must be understood in the context
of society as a whole. Because it is their relationship to society-or their inability to fit into the societal class to which they aspire-that drives them to commit murder.
