happened was that an all white jury found him guilty and recommended a sentence of death ("Court Will Hear Louisiana Death Case," 2007). Some claim the verdict was racist
because of the composition of the jury, but it was not only that fact which caused a ruckus in this case. The use of peremptory strikes did result in the
removal of five potential black jurors (Liptak, 2007). In other words, there had been the possibility of a mixed jury pool, and after all, justice is served when a jury
of ones peers sits in judgment, but the jury turned out to be all white. At first, the Louisiana Supreme Court did not find that race played any role in
the case ("Court Will Hear Louisiana Death Case," 2007). However, the United States Supreme Court agreed to hear the case ("Court Will Hear Louisiana Death Case," 2007). Interestingly, in the
past, efforts to control the exclusion of jurors due to race have not been successful and there are quite a few other cases in the region that ended up with
death sentences when black men sat trial with white juries (Liptak, 2007). Although the prosecutor claims that the decisions were not based on race, Snyder refers to Batson v. Kentucky,
a case in 1986 that would not allow the practice of eliminating jurors due to race ("Court takes on local race-bias case," 2007). How will the nine justices of the
