in keeping unions out of their companies. A large corporation that come immediately to mind is Wal-Mart, the largest retailer in the world. Other successful but large corporations in which unions failed are the old IBM and FedEx. FedEx is now on the precipice because of the new presidents comments and regulations associated with economic bailout money. Of the hundreds of thousands of FedEx employees, only the pilots are unionized (Bomkamp, 2009). This is because FedEx has been able to block the union because its workers fall under the rules of the National Railway Labor Act (Bomkamp, 2009). FedEx has fought hard to legally block unionization specifically because of this Act, which states that employees may become unionized only if all employees of the corporation vote at the same time to do so (Bomkamp, 2009). The bailout from which UPS, FedExs arch rival, may change that. The new regulations would put FedExs employees under the National Labor Relations Act, which allows departments or locations to unionize (Bomkamp, 2009). In other words, employees could organize and accept the union one terminal location at a time (Bomkamp, 2009). Thus, the way FedEx legally blocked unionization was through the classification of their employees. Every company does not have that option and in fact, under the new presidents ideas, unionizing would become easier and easier. Consider, for example, the speeches during the campaign when he proposed that "union certification could be based on a card check: "If 50 percent of employees plus one sign cards saying they want a union, thats it. Done deal. Union certified" (Maslanka, 2008). Its called the Employee Free Choice Act (Maslanka, 2008).
