The concept of hate crimes is, in fact, a concept which has only received its label in contemporary times. Although such crimes existed in
the conservative era as well there was not the degree of societal cognizance which exists today. As our awareness of hate/bias crimes has increased, so too has the recognition
that our prosecutorial arms must be prepared to adequately prosecute such crimes to the fullest extent of the law. Hate crimes
or so-called bias crimes can take a number of different formats. So too can the legal prosecutorial provisions for those crimes. Practically every state has provisions for delineating
and prosecuting hate crimes apart from regular crimes. This prosecutorial effort can be directed against misdemeanor hate crimes and felony hate crimes alike. Felony hate crimes, of course,
have more severe consequences than do misdemeanor crimes. The National Gay and Lesbian Task Force (2009) notes that in Arizona, for example, hate crimes are delineated on the basis
of whether they were committed "out of malice for a toward a victim because of the victims identity in listed groups". When a hate crime is committed on federal
property such as a national park, prosecution falls to the federal government. Bush Administration Policy
The Bush Administration was well aware of the issues surrounding hate crimes. That Administration favored strong criminal penalties for all violent crimes
including those crimes that were based on "personal characteristics, such as race, color, religion, or national origin" (Executive Office of the President, 2007). When considering the merits of a
