is not unusual for prospective candidates for Supreme Court Justice to be subjected to considerable criticism during the screening process. Such was certainly the case with the Harriet Miers
nomination during the George W. Bush administration and the Elena Kagan nomination made by President Baraq Obama. The tendency for nominees to be seriously criticized during the nomination process
seems to be consistent regardless of the qualifications of the nominee for the proposed position. In the past nominees have been attacked despite the fact that they were superbly
qualified for their potential post on the Supreme Court. Instead of being based on valid concerns over qualifications the criticisms that are hurled their way are often based simply
on political affiliation. Sometimes, however, the criticism that emerges in the review process, valid or not, is launched from the candidates own political party.
Supreme Court Justices are nominated for their positions by the President of the United States (Garbus 37). Prior to their taking a seat on the Supreme Court,
however, prospective candidates are weighed out in a formal hearing conducted by the Senate Judiciary Committee (Garbus 37). The purpose of this hearing is to assess the candidates appropriateness
to serve as Supreme Court Justice. Prospective candidates must first pass through the Senate Judiciary Committee before they are passed to the full Senate for final approval (Garbus 37).
