paper will then propose a written policy statement for management approval. In addition, it will outline associated procedures and outline an implementation schedule. Finally, this paper will address
any possible implementation issues with suggested plans to counter them. Issues of Law Kureks contention, which was laid aside by the Court, insisted that the
School District was, in effect, enforcing work rules that had been broken by others in the past, in order to evade their responsibilities under the Rehabilitation Act.
The issues of law had to do with the stated policies of the Allegheny School District and how they were put into practice by the School
District with Kurek and others. The two concerns addressed by the court in handing down its verdict were (1) is the policy as distributed by the Allegheny district clear
about the amount of hours required, and (2) is the District consistent in its application of the policies. A great deal of the decision
was concerned with the charges from Kurek and the answers from the District about exceptions to the 7-3/4 hour work policies and how they were applied. In the two
instances cited, athletic coaches and cafeteria "extra duty," there was a clear and traceable trail which exempted those examples from setting a precedent for Kureks charges: * In the case
