amuck. This proclivity to assume guilt before innocence prompted many employers to pursue the practice of using hidden cameras and surveillance in the workplace, including the washrooms. At what point
does this become an invasion of privacy and is it constitutional? The proposed paper will examine several case studies where the employers utilize onsite surveillance of employees. The scope
of the paper will narrow its focus on the utilization of surveillance, the rationale that employers use, and the justification under which they may or may not be allowed to
continue the practice. Lastly, an examination of a persons right to privacy and the constitutional rights of the average citizen will be examined to determine if these widespread practices should
continue. The use of the hidden camera is nothing new, but the context in which they are being utilized is a source of great debate(Sableman 2004). Hidden cameras were the
stock and trade of investigative journalists for decades, were even the stuff that spies were made of. However, now the use of hidden cameras, whether hidden in the work space
or mounted clandestinely on another undercover employee has civil liberties unions and many workers claiming that the right to privacy has been breached. It is this context that the paper
will address. Current areas under research for this paper include interviews from Civil Liberties Unions and the legalities involved with clandestinely taping and obtaining video footage of workers. Eavesdropping laws
do vary from state to state and this must also be considered when determining the constitutionality of the practice. The ACLU reports that it receives more complaints about workplace rights
