this case one man was forced to defend himself because the court would not provide counsel, something that is now common practice in law. The following paper examines this court
case and discusses how it involves the right to an attorney, the 6th and the 14th Amendment, inequality, and Miranda rights. Gideon v Wainwright In understanding the case
and its importance to the judicial system it is important to first describe the case. In this case a man, Clarence Earl Gideon, was accused of breaking into a poolroom
and robbing the establishment. Someone had claimed they had seen Gideon in that poolroom early that same morning and "When Gideon was found nearby with a pint of wine
and some change in his pockets, the police arrested him and charged him with breaking and entering" (Landmarkcases.org, 2006). As can be seen, there was not much evidence that Gideon
was the criminal and he was generally known as a drifter around the town, essentially something of a homeless man. The point was that he was quite poor and
did not have the money to afford a lawyer. He approached the court and claimed that he had a right to an attorney, and should be provided with an attorney.
"The judge denied his request, ruling that the state did not have to pay a poor persons legal defense unless he was charged with a capital crime or special circumstances
existed" (Landmarkcases.org, 2006). Gideon had to defend himself and was found guilty. As would be expected of an average and perhaps undereducated man, he did not do a very good
