rights of employers versus the rights of employees, regardless of their sexuality. However, the right of self-determination must necessarily acknowledge the right of employers to make the decisions they
feel are in their own best-interest, even if this conflicts with the interests of potential employees. However, it is important to distinguish
that rights exist on both sides of this issue. The Constitution guarantees the rights of all citizens, regardless of age, race, sexuality or any other factor. In this
way, this inherently determines that all individuals have the right to seek employment without fear of discrimination based upon their sexuality (Religious Intolerance, 2004). In other words, gay individuals
should be protected from discrimination in the workplace, but that protection cannot collide with the inherent rights of employers to make the decisions they deem necessary either.
The problem historically has been that Americans can be legally fired from their jobs in most states based upon their sexual orientation (Religious Intolerance,
2004). Wal-Mart has been a leader in showcasing a more liberal employment policy (Religious Intolerance, 2004). Wal-Mart has "expanded its antidiscrimination policy to protect gay and lesbian employees"
(Religious Intolerance, 2004). Pressure from lobbyists has prompted this decision but it appears to be a growing trend in the marketplace (Religious Intolerance, 2004). This is further evidenced
by studies of Fortune 500 companies showing that anti-discrimination policies are becoming far more tolerant of gay employees (Religious Intolerance, 2004).
Lobbyists and other gay rights organizations work diligently to initiates reforms that will cause employers to be required to hire gay employees (Using Principles to Change Employer Practices, 2004).
