In 2003, President George W. Bush and his administration were roundly criticized for not supporting the Kyoto Agreement that deals with reducing carbon emissions to promote global warming. Bushs contention
was he didnt like the loopholes that excluded the emerging nations; and with this he had a good point. But his other contention, that the provision of the agreement would
put a financial hardship on businesses for compliance are what netted the harshest criticism. Some of the issues that have cropped up
legally tend to support this assertion, to an extent. The Tuna Dolphin GATT Case in the early 1990s pitted the U.S. against Mexico when the latter banned imports of Mexican
tuna because of the numbers of dolphins being killed through use of the purse-seine fishing technique1. Mexico believed the ban went against the GATT treaty that both countries had signed2.
Some years later, an analysis of Shrimp/Turtle showed the complaints from several Asian countries complaining that Section 609 of the Endangered Species
Act was "an impermissible restriction on trade under the GATT"3. In this particular case, the regulation prohibited importation of shrimp into the U.S. unless a countrys shrimping program included the
use of turtle excluder devices similar to those used in the United States4. The problem that the Appellate Body of the World Trade Organization was that of the U.S. was
treating countries somewhat differently, and this would not stand5. Still, Shrimp/Turtle and the Mexican tuna case before it demonstrate a definite tension between local environmental protection and global trade. Those
