Fullertons coach Gallagher was unaware that "the state legislature made it unlawful to pay students to attend universities or colleges." It is the coachs responsibility to know the
legal restraints on his job and position with the university. As ignorance of the law is no defense in traffic violations or murder, neither is it a defense in
the matter of recruiting star athletes. It can be argued that the coachs business is football, not law, but there are restraints that are college athletics-specific as well. Illegal
Recruiting The National Collegiate Athletic Association (NCAA) takes quick and deadly action against any member school offering benefits to student athletes that can
in any way be construed as paying the student for attending a specific school. The University of Washington lists several seemingly-innocuous things that the NCAA would see as violation
of its prohibition of extra benefits. Paying cash to an athlete is blatant violation of NCAA rules; the rules are so stringent that so much as paying for a
haircut for a student athlete opens the school to punitive action by the NCAA (Compliance Corner, 2007). Not only did the coachs actions run afoul of state law, they
also opened the school to official punishment by the NCAA. Kyle can expect Fullertons lawsuit against him to be dismissed because it is seeking the return of an illegal
payment. Lailas Poor Judgment Laila was accepted by Fullerton, NYU and Stanford. NYU was her first choice of school, but she offered
to attend Fullerton if Kyle accepted the scholarship the school offered him. There is no indication that Kyle asked Laila to attend Fullerton or made any promises to her
