Here are also the claims of the need for safety checks in France, with the Autos AG expected to pay for these additional checks. The EU is a free trade area, this mean that is all but a few exceptional circumstances there should be no barriers to trade. The imposition of duty at an excessive rate is in effect a covert tariff. Under Article 23 (ex 9), the EU is declared as a customs union, and customs between member states is prohibited, this includes any taxes that have an equivalent effect (Lexis, 2004, Weatherill and Beaumont, 2000). Article 25 (ex 12) abolishes all customs, and any charges that are imposed by a country on another member states goods (Lexis, 2004, Weatherill and Beaumont, 2000). This is also supported by case law such as Case C - 363/93 et al Rene Lancry S A et al v Direction General des Douanes [1994] ECR I - 3957 and also in Case 7/68 Commission v Italy [1968] ECR 243 [1969] CMLR I (Weatherill and Beaumont, 2000).. In this later case is was goods leaving rather than entering a country, but the application is clear (Weatherill and Beaumont, 2000). Where there is the aim to raise money for the exchequer this is an easy argument, however, we are not told why the taxes are heavier on these vehicles than others.
