collectively known as the Bill of Rights. The rights ensured in these amendments were considered by the Founding Fathers and the original States to be fundamental to the American way
of life. In this regard the First Amendment is considered to be the most significant, as it ensures freedom of religion, freedom of speech, freedom of the press, and the
right of the people to peaceably assemble and petition the government for redress of their grievances ("U.S. Constitution"). However, while the right to freedom of speech has always been
part of the fabric of law and culture in the US, this right has been considered, either by the public or the courts, to be absolute. As a Supreme
Court Justice once pointed out, the First Amendment does not give one the right to shout "fire" in a crowded theatre simply to watch the people panic. In restricting free
speech, the government has to show that such restrictions "serve a compelling state interest" and also any imposed restrictions are "narrowly tailored to achieve that end" (Johnson 157). This is
the rationale that the US Federal Communications Commission (FCC) used in crafting the policy that was known as the "Fairness Doctrine," as it was an attempt to "ensure that all
