A 3 page paper discussing implications of changes in regulations surrounding passenger facility charges (PFCs) and the Airport and Airway Trust Fund (ATF). Expansion of the types of uses that airport authorities may give PFC funds will help to bridge the gap occurring in the face of diminished receipts for the ATF. Airports still will be able to gain the same results as before decline in the FAA's budget, but those results will be funded by already-stressed airlines rather than by government agencies. an issue of escalating relevance in recent years. Always an issue of importance, it moved into the realm of critical as of September 11, 2001. The very essence
of developing an effective security policy is dependent in great extent to the level of risk that exists. We know all too well the level of threat that exists
for airlines and their passengers. Passenger Facility Charges Airport authorities have borne the weight of responsibility for increasing and maintaining security levels interfacing
between the ground and the air. The airline industry has been distressed for years, with only venerable Southwest Airlines still maintaining profitable quarter after quarter. Every other major
airline is losing money hand over fist, continuing a trend begun with the terrorist attacks of September 11, 2001. Already in financial distress prior to the attacks, the cessation
of travel immediately following the attacks; the parking of older aircraft in response to the attacks; the Asian SARS epidemic; and travelers fear of travel immediately following the terrorist attacks
all combined to severely restrict air travel for months following the attacks and exacerbate airlines already-precarious financial positions. The passenger facility charge (PFC)
is one source of income that airports have available for use in airport construction projects. This fee is collected by the airlines for the benefit of the airports the
flights are using. One of the problems that airports have had in recent years has been collecting PFC funds that airlines have collected from passengers but have not forwarded
to airport authorities. Congress ordered that airports would be able to use PFC funds "receipts to pay off the debt on projects that
