Appealing to Prejudice: Prejudice in arguments is "literally a judgment made before the facts are in". Arguments which play on the prejudices of the audience are known as Ad populum or "to the people" and often use statements such as "most people agree that" (Cross, 2002). In the arguments presented by opponents of same-sex marriages, an appeal of Ad populum is used frequently as they argue those who support same-sex marriages are in the minority while the majority opposes it. Nevertheless, gay activists cite that they are being "discriminated against" because they are a minority. In order to make a claim of discrimination based on prejudice however, adds opponents to the legislation "one must be a member of a protected or suspect minority class, or a member demonstrably practicing (not merely believing)" (Marco, 2002). Appealing to Pity: Arguments which are based on the feelings or emotions, especially pity or fear, are meant to "draw attention away from the real issues or to conceal another purpose" (Cross, 2002). Opponents to same-sex marriages also oppose gay activists appeal to pity in regards to their arguments. The gay appeal is based on the continued "oppression" of homosexuals and therefore "society owes sexual orientation suspect class minority status, marital status and all accompanying benefits to redress injuries done to gays and to make them feel better" (Marco, 2002).
