children for whom they are intended. The Letter Dear Industry Members, As you are all too well aware, the tragic deaths of two
children in 1999 due to choking on giveaway toys received in a fast-food childrens meal precipitated manufacturing involvement and product safety testing by at least two members of the fast
food industry, McDonalds and Burger King. McDonalds created McBaby, a dummy with artificial lungs that can mimic the action of choking in a child. Until now, McBaby has
been available only for McDonalds private use in testing toys, but in a recent meeting with the company, McDonalds agreed to make McBaby available for competitors use as well.
It is the position of the Consumer Product Safety Commission that restaurants should be responsible for all of the products they make available to
customers, a position that most of the industry shares. McDonalds and Burger King have led the industry in ensuring the safety of the
toys they distribute with their childrens menu items. Each currently uses independent testers before and during manufacturing to ensure that products meet stringent safety tests. Not all members
of the industry are in a position to take the action that McDonalds and Burger King have decided to use, but thanks to McDonalds kind gesture stemming from its commitment
