Helga and Ian would like to legally solidify the relationship between Ian and Gillian and have sought legal advice about their options in order to determine the most appropriate course of action for Gillian. Before determining the best course of action for this couple, there are some additional pieces of information that are needed. Specifically, it is valuable to know the nature of the relationship between Helga and Frank at the time that Gillian was born. Where they married? If Frank and Helga were married at the time of Gillians birth, he would have been registered as the father at the time of the birth and Gillian would have been noted as a child that was a product of the marriage. This distinction is important in the eyes of the Court in terms of designated specific parental responsibility and determining the type of process that might occur for Helga and Ian as they seek means of securing the relationship between Ian and Gillian. Specifically, Franks parental rights are viewed slightly differently if Gillian is a product of marriage versus a product of a union of two unmarried individuals. At the same time, recent changes in the Adoption and Children Act of 2002 suggest improvements in the views of the rights of unmarried couples and so Frank would still have rights even if they were unmarried at the time of Gillians birth.
