for specific reasons: the birth or adoption of a child and care for that child; to care for a close immediate family member; or for their own serious illness that prevents them from doing their job (OPM, n.d.; Vikesland, n.d.). An employee who is eligible under this Act is one who has worked for that employer for a minimum of 12 months and has worked at least 1,250 hours (Vikesland, n.d.). Companies who have at least 50 employees who live within 75 miles of the company location must adhere to this law (Vikesland, n.d.). Also, at least 50 employees work 20 or more weeks in the calendar year (Vikesland, n.d.). All public agencies must adhere to the law no matter how many employees they have (Vikesland, n.d.). This is unpaid leave time (OPM, n.d.; Vikesland, n.d.). During this time, the employee is may continue their benefits at the company but must continue to pay their share, whatever that has been (Vikesland, n.d.). The employer must continue these health and welfare benefits. Another caveat is that if the leave is for the birth or adoption and care for that child is to two parents who work at the same company, they may not each take the leave 12 weeks nor may they take that time together to care for a family member (Vikesland, n.d.). In other words, couples may take a total of 12 weeks between them. These 12 weeks do not have to be taken consecutively, they can be intermittent (Vikesland, n.d.). For example, if the employee is capable of working part-time, then, the hours not worked would be applied to the FMLA (Vikesland, n.d.).
