et al, 2002). Furthermore, the act prohibits such bribery to influence an official act or decision of the person being bribed; influencing a person to perform any act in violation
of his or her lawful duty; encouraging that person to use his or her influence to influence a governmental decision or gaining an improper advantage to direct or obtain business
to a person (Price et al, 2002). In this case, "foreign official" is considered an officer or employee o a foreign government, or related department, as well as employees of
certain international public organizations (Price et al, 2002). In terms of U.S. businesses, the act applies to U.S.-based parent companies that oversee
or direct acts performed by their subsidiaries in other countries (Price et al, 2002). The question here is, however, how does this
law impact competitiveness of a U.S.-based company as opposed to companies based in other countries (in other words, the competition to U.S. companies). On the surface, it could be judged
that giving of gifts is one way in which a U.S.-based company could likely gain a competitive advantage over a foreign entity. In fact, since the passage of the FCPA,
many American companies have complained that theyre at a disadvantage in international trade because they dont have any leverage among the government.
