Eye witness testimony is considered by many in our society as the most reliable means of
deciding guilt or innocence. If a defendant was observed committing a crime and a witness testifies that that is the case then there shouldnt be any doubt as to
his or her guilt. In actuality, however, substantial evidence exists that eye witness testimony can be flawed by several elements that tend to fade the memory of what was observed
or to even subconsciously alter it. Some witnesses have even gone so far as to lie about what they observed so that they could aid in convicting a certain
individual. Never-the-less, eye witness testimony retains high importance in criminal law proceedings. In-court identification of defendants is a particularly important component of those proceedings.
Despite the importance that eye-witness testimony holds in the judicial process there is considerable room for error in that testimony. Moses (2001) observes the precarious nature
of eye witnesses that results because of: "fallible sensory perception and memory and from suggestive
influences" To illustrate this problem it is helpful to consider a fictional scenario involving a
bank robbery. Although the robber was observed during the robbery by a number of individuals in the bank he managed to both enter the bank prior to the robbery
and exit the bank afterward without being seen. When police canvassed the area, however, a witness that lived in close proximity to the bank revealed that he had observed
