State Capitol 210 Capitol Avenue Hartford, Connecticut 06106 Dear Governor Rell, As you requested, I am writing in response to the
questions raised by the activities of Ralph Hoozgow, commissioner of the State Department of Corrections. As you suspected, there are changes that must be made right away.
As an elected official, Mr. Hoozgow is subject to the laws and rules of ethics governing the activities of elected officials. In addition to
the original three points of concern, research reveals a fourth. As an elected official, proper behavior on Mr. Hoozgows part would have included action on Mr. Hoozgows part to
remove himself from the Board of Directors of the North American Corrections Company, Inc. (NACC). This is governed by Public Act No. 04-38, passed in May 2004 and effective
as of July 1, 2004. Without any direct business activity between NACC and the State of Calibama, Mr. Hoozgows continued association with NACC was questionable at best and the
proper, ethical action would have been for Mr. Hoozgow to choose between remaining on NACCs Board and remaining in his present office. Additional implications of present activity will be
addressed below in Point 3. Point 1 Mr. Hoozgows recent decision to place microphones in common areas and meeting rooms of state correctional
facilities superficially is a sound one. Anyone directly involved in corrections understands the difficulty of maintaining order and controlling inmate activity. The very presence of the microphones could
serve as a deterrent to those inmates who would operate businesses from within prison and likely serve to discourage those who would attempt to either deliver or solicit contraband.
