As bad as drugs are and as much damage and further problems they can and do cause, a charge of or conviction for possession with intent to distribute appears to be far less serious than does murder. If the punishment were truly to "fit the crime," then it would appear that drug possession and drug trafficking would carry a lesser sentence than does murder. The opposite often is seen to be true, however. The scenario considered here is that sentence for possession with intent to distribute carries a sentence of no less than 10 years and no more than 40 for a first offense and life for a second; murder is punished with sentences of 5 to 20 years with no increase in severity with a second offense. This is a continual source of frustration for the general population, to whom it appears that all sense of priority has been lost in determining prison sentences for specific crimes or classes of crimes. Does a much longer sentence for drug involvement than for murder indicate that the court system sees murder as being of less importance? Theories of punishment indicate that the above is an invalid association. Certainly murder is serious, but it also - by definition - is a one-time event relative to a single victim. In contrast, drug selling is ongoing and continuous. Individuals can extract themselves from surroundings in which murder is not a far-fetched concept; individuals using the drugs that drug sellers provide typically are addicted and are driven to do anything necessary to ensure a continuous supply of the addicting substance.
