A 5 page paper assessing the policy under which a local judge faces a hearing resulting from complaints that he has not acted outside of the courtroom in ways consistent with expectations of judges. The California Commission on Judicial Performance announced in 2002 that it will conduct a hearing on the conduct of San Francisco Judge D. Ronald Hyde. Judge Hyde has been accused of several acts of misconduct, all of which are blatantly trivial. The purpose here is to review and assess the policy that dictates that Judge Hyde be subjected to a formal hearing that potentially could end his career. The paper suggests altering the policy so that there is greater accountability on all sides. Bibliography lists 3 sources.

Judicial Performance announced on October 31, 2002 that it will conduct a hearing on January 21, 2003 on San Francisco Judge D. Ronald Hyde. Judge Hyde has been accused
of several acts of misconduct, including using motor vehicle records for personal use, arranging for a friend to hear his daughters small claims case and telling off-color jokes in the
presence of women at a Thanksgiving office party in 2000. Judge Hyde was censured by the state judicial commission in 1996 for similar complaints.
The purpose here is to examine the policy under which Judge Hyde will undergo hearing, reporting results to the legislative committee overseeing such matters. The policy in
question is that which requires the judicial committee to hold a hearing now because of the existence of similar charges in the past. Policy Examination
The policy is a lawful one, formulated to guard against judicial misbehavior, provide accountability and impose disciplinary action where appropriate. The Commission on Judicial Performance has the
authority to remove Judge Hyde from his position if it finds that conditions warrant such action. Statewide, between 800 and 1,000 complaints are filed against judges each year, only
six to 10 of which will reach the point of going to formal hearing. Since 1960, 18 judges have been removed either by the Supreme Court or the judicial
