The death penalty has consequently been in and out of favor among the general public, the states, and
the federal government alike since the beginning of our countrys history. Never-the-less, it has been utilized relatively frequently throughout most of that history. That utilization, however, has primarily
been with adults. While there are many ethical implications of imposing the Death Penalty adults, there are many more to consider when we consider juvenile offenders. Not surprisingly, the
U.S. Supreme Court knocked down that application in a 2005 case ruling. In Roper v. Simmons the Court ultimately held that the Eighth and Fourteenth Amendments to the
US Constitution "forbid imposition of the death penalty on offenders who were under the age of 18 when their crimes were committed" (Roper v Simmons, 2005).
Unfortunately, the sad truth is that "attitudes towards capital punishment are the product not of reason, but of emotion (Cook, 1998, p. 7)." While the
various states have batted the issue of capital punishment around considerably over the past five decades in particular, the federal government would lie quite on the issue until after the
