health, who earns ?25,000 a year. In each of these cases it appears that Linda has the least advantageous terms and is also a woman, as such there may be
an issue in terms of equal pay. Equal pay for men and women is part of EU and English law. The EU
law that protects these workers and ensures there is equal pay is Article 141 (the old 119) of the Treaty. The first paragraph of this article states "Each member state
shall ensure that the principle of equal pay for male and female workers for equal work or work of equal value is applied" (Lexis, 2002). We can argue that this
is only a part if the entire spirit of the law, with gender equality issues also seen in Article three of the treaty at Article 3 (2) (ex 3 ),
which specifies similar sentiments in a more general statement (Weatherill and Beaumont, 2000). In the case of Defrenne v SABENA case 43/75 [1976] ECR 455 can be used to show
