the more prominent of those rights is equality. Despite the fact that equality was a primary focus of our founding fathers, equality has never truly been achieved in our
country. The harsh reality is that certain racial, ethnic, and cultural groups in American society have been considered everything but equals. Indeed, equality has never been achieved even
in terms of the sexes. This is true in practically every facet of American society but it is particularly true in regard to employment.
The history leading up to the Civil Rights Act of 1964 was, of course, complex. Certain periods of that history had been particuarly intense in regard to
issues of equality. The Civil War was one such period. Even the Civil War failed to achieve true equality in the United States, however. While the institution
of slavery was abolished, equality was never actually achieved for ex-slaves or even for those African Americans who had never actually been in bondage.
Although the 13th Amendment was ratified in December of 1865, almost one hundred years before the Civil Rights Act of 1964, its provision that "neither slavery nor involuntary
servitude, except as a punishment for crime, whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction" was not
immediately upheld. Blacks were, in fact, forcibly denied basic human rights and finally in 1871, after a continued increase in violence, an Enforcement Act was passed which severely punishing
those who attempted to deprive the blacks of their civil rights. Even with such strict penalties as those noted above in place,
