Labor Act (EMTALA) was implemented for the purpose of insuring that individuals presenting to hospital emergency departments receive adequate care regardless of whether or not they have the ability to
pay for that care. Adequate care in this case demands first the emergency department actually insures that medical personnel see the patient rather than turning them away without medical
review. While some contend that EMTALA does not actually provide for better care and in reality only increases the use of defensive medicine, the reality is that prior to
EMTALA some hospitals could and did turn people away even in life threatening situations if they did not have the means of paying for treatment. While, as recent lawsuits
attest, EMTALA is not perfect, it is an improvement over what we had previously. Not only does EMTALA require medical personnel to see
the patient in these instances but it also requires them to evaluate, treat and stabilize the patient in regard to their emergency situation. What this means is that a
patient might not actually be cured of their condition but that their condition must be deescalated from one comprising an emergency to one comprising chronic illness or injury. Consider,
for example, an individual coming to the emergency room complaining of chest tightness and difficulty breathing. EMTALA requires the emergency room to determine the reason for the emergency situation.
If the reason is a heart attack then the follow-up care that would be necessitated would be very different than if the reason were chronic asthma. Stabilizing a
patient experiencing a heart attack would likely require much more extensive intervention than stabilizing a patient with chronic asthma. While under the conditions of EMTALA the asthma patient might
