However, it can just as easily be said, that the Constitution allows for a certain amount of slack in the system as not to create a stranglehold that would barely pass as democratic and instead resemble a dictatorship. Has the courts approach to the constitutional issues shifted constantly with the various waves of new Justices set to the bench? It can be said that the approach hasnt shifted so much as the circumstances in which the Justices find themselves these days. One of the most recent red flags that have come up under the Civil liberties banner is the fact that President Bush, shortly after September eleventh, stated that non-citizens were to be tried in a secret military trial(Reeves, 2002). This coupled with the fact that wire taps had been approved for use for anyone they had reasonable cause to suspect of terrorist activities set civil liberties groups to crying foul. Many claimed that there are no hard and fast rules and that the rules dont count, votes count and those with the most votes decide policy. However, this is an exaggeration, surely, as there has been a precedent for this type of secret military trial. It occurred in 1942 during the World War Two. Eight Nazi soldiers were found coming onto United States soil, loaded with explosives to be used against both military and civilian institutions(Reeves, 2002). They were caught and immediately tried by a military tribunal, ordered by President Roosevelt.
