charter. For purposes of this paper, weve chosen the First and Second Amendments from the Bill of Rights of the United States Constitution. Analyzing and even rewriting these two amendments (not that we could do so in real life without authorization from the U.S. Congress) is a good exercise in that in past years, these two amendments have generated a great deal of controversy in terms of law and in terms of interpretation. If they were worded somewhat more clearly, perhaps there wouldnt be this problem of interpretation. Before we begin with analyzing these two amendments, lets first describe them. Overall the purpose of the Bill of Rights was to outline, in as great detail as possible, the rights and freedoms according to most Americans at the time (actually, most male white Americans as people of color were not necessarily recognized as bonafide U.S. citizens, nor were women). Given that the Constitution itself was drafted during a time of war, and a time during which the colonies were struggling to define themselves, Constitution author Thomas Jefferson penned these Bill of Rights to reflect the times. Since that time, historians have pointed out that the Constitution (and its Bill of Rights) is a living document, which was written in such a way so as to fit the times. While this might be true for many of the amendments, the first two amendments seem to be generating a great deal of difference of opinion. Lets examine them and see if we can improve upon them.
