article (this seems to be primarily a 1990s phenomenon), employees packing too much weight also can lead to increased absenteeism. What, then,
is an employer to do about this problem? Can an employee legitimately "order" an employee to lose weight and/or improve his/her health in an attempt to cut costs and increase
morale and production? Can an employee actually be hired based on how physically fit he or she is? There is no black
or white answer to these questions. It pretty much depends on the job, for one thing. As well see in this paper, certain jobs require that an employee be fit
on the job. But what about those jobs that may not require it? Does an employer have the right to demand that an employee be fit?
The primary answer is no - the employer does not have the right to do this. The employer can, however, encourage the employee to get and
stay fit through many incentives. And in going in this direction, the employer can end up saving many health care and other types of costs.
In this paper, well examine the concept of whether employees can or cannot be hired/fired based on physical fitness, and what we find will support the contention
