concept of due process is a critical cornerstone in individual rights of American citizens. Due process dates to the Fifth Amendment of the U.S. Constitution and refers to the
due process of law. More specifically, the Fifth Amendment states that no person shall be: "deprived of life, liberty, or property, without due process of law" (Patrick, 2001).
This concept was elaborated on more fully in the Fourteenth Amendment. Adopted just after the Civil War and three-quarters of a century after the Fifth Amendment, the Fourteenth Amendment
echoes in many ways the provision of the Fifth Amendment that kept states from depriving any person of his or her "property". Included in the provisions of the Fourteenth
Amendment is a requirement that all states provide equal protection of the laws. This Amendment specifies that no state can:
"deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection
of the laws" (Cornel University, 2000). Due process has had a definitive impact
on the delineation and definition of the rights of American citizens. Interestingly, however, our understanding and interpretation of due process has changed considerably over time. The theme can
thus be presented that our interpretation of due process could be considered evolutionary. In line with this theme is the contention that after the September 11, 2007 terrorist attack
that destroyed the World Trade Center in New York City and the subsequent attack on the Pentagon itself, our interpretation of due process has evolved at a more rapid rate
