When a death occurs because of an automobile it is tragic. It is even more tragic when a young child
is involved. Consider, for example, the scenario where a young child runs out into the street after a ball. The child is struck and killed by an automobile.
The parents are grief stricken but they are not too concerned with the precise state of mind of the driver at the time of the accident. After all,
as Kaveny (2009) emphasizes, "a victim hit by a car and killed is just as dead whether he or she was run over by a ruthless hit man, crushed by
a blindfolded joyrider on a busy pedestrian walkway, or sideswiped by a drunken driver" (109). Despite that fact, the law is concerned with whether the driver was acting intentionally,
knowingly, recklessly or negligently. Indeed, the level of intent associated with the drivers actions will undoubtedly determine the offense with which the offender is charged, and accordingly, the corresponding punishment.
The intent of this paper is to explore why the level of intent is a critical factor in classifying this type of crime and in determining the punishment.
