Americans take many things for granted in our society. Freedom of expression is one of those things.
Freedom of expression is provided by the First Amendment which specifies that Congress shall pass "no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging
the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances". Freedom of
expression, however, is defined not just by the First Amendment but by Constitutional law and the thesis must be presented that:
Constitutional law serves not just to proclaim our freedoms but also to define them in ways that in effect sometimes limit them.
The intent of this paper is to discuss those limitations as they apply specifically to freedom
of expression and, even more specifically, to the question of whether we are assured the right to burn an American flag as a means of expressing ourselves. Constitutional law
