Discrimination and the Law-Continuing Disappointment In Ohio, a guidance counselor tries to help a frightened young woman who is just beginning to realize that she may be attracted to girls; in response, the counselor confides that she is a lesbian, and that its not the "end of the world" (Mohr, 2004, p. 30). The girl is greatly comforted and the counselor, "[B]uoyed by her success counseling this student and another gay male student ... begins to mention her bisexuality to some of the schools faculty. In consequence, she is fired" (Mohr, 2004, p. 30). She sues, but her case "bounces around for over ten years, finally reaching the U.S. Supreme Court, which isnt interested in hearing it (Mohr, 2004, p. 30). "And so the Court lets stand a ruling that allows Ohio to fire all its gay and lesbian school teachers on the basis of their sexual orientation alone" (Mohr, 2004, p. 30). This legal situation remains unchanged, twenty years later (Mohr, 2004). In law, much of the difficulty gays and lesbians face appears to hinge on the way in which the concept of equality is defined (Mohr, 2004). While there is a "century-old belief that governments, both state and federal, should not be allowed to discriminate" the constitutional promise of equality does not currently extend to lesbians and gay men (Mohr, 2004). Further, "[N]either the Supreme Court nor any of the thirteen federal Circuit Courts has viewed gays as having the same levels of protections against governmental discrimination that blacks, women, and even illegal immigrant children have" (Mohr, 2004, p. 30).
