just level the playing field because it requires employers to provide accommodations (Stein, 2004). In other words, if someone who is disabled needs a certain type of chair or desk,
and it is of a reasonable cost to the employer, then the employer cannot discriminate against the person by not hiring them, and further, they would be required to make
the special desk or chair available to the new hire. Many see ADA as relevant in their fight against unfairness in hiring and retention practices. In the past, employers
might decide that they cannot hire a person with a disability because it would be too arduous to accommodate such individuals. Yet, ADA makes it mandatory that people be hired
even with a disability, and that the employer must make suitable accommodations for that handicap. Yet, ADA has been used in a number of ways. Olsky (2000) looks at a
case where a diabetic was rejected from a police department because of his illness. The case involved Michael Bombrys who wanted to join the Toledo police force (Olsky, 2000). In
Toledo, applicants for law enforcement who are diabetic are automatically rejected (Olsky, 2000). This is not an unreasonable policy. The military will not take applicants with chronic diseases because health
maintenance would be too taxing in the throes of war. Similarly, one does not want a police officer in pursuit of a criminal to have to stop to take an
insulin injection, or in the case of another chronic disease, have to tend to his or her health. Thus, physical fitness is a part of the requirement. However, in this
case, it is argued that a well controlled diabetic could be a good candidate fro the force. Brombrys brought a lawsuit against the city under ADA (Olsky, 2000). Yet,
