Supporters of instituting the death penalty in Michigan cite the record-breaking number of murders that have taken place in Detroit in recent years as the most viable reason for utilization of the laws ultimate penalty, which is an argument that focuses on the death penalty as a deterrent to crime. Proponents of capital punishment in the US generally rest their case on three arguments: deterrence, incapacitation and retribution (Bedau, 2004). Death penalty opponents offer persuasive and legitimate objections to the way that the death penalty has been utilized in this country; however, ultimately, it has to be acknowledged that there are cases in which capital punishment is the only legitimate response to the heinous nature of some deeds. Opponents to the death penalty point out that empirical research does not support the supposition that the death penalty has any effect as a deterrent to crime and, therefore, the nations leading criminologists do not endorse its use in this regard (Bedau, 2004). As for the death penalty being justified in that it removes or incapacitates criminals, protecting public safety, opponents say that the experience of states, such as Michigan, where the death penalty is not practiced, as well as numerous other European countries, illustrates that incapacitation without the death penalty is possible through incarceration (Bedau, 2004). Even when these two rationales are negated, the justification of retribution remains strong with many Americans. Opponents argue that the emotional closure that victims families believe they will experience is an illusion and that empirical evidence fails to support this pro-death penalty argument.
