However, the law does place an obligation or duty on employers to take actions to prevent discrimination occurring and to take action when it does occur. The law may be able to regulate behaviours and seek to provide motivation to gain compliance as well as serve as a way of penalising non compliant employers. For Mary, this means there is a potential actionable case due to the discrimination that is occurring, for the employers this means there is a potential liability that could harm the firms image and have a financial cost. Therefore, when the issue is brought to the attention of the management there should be clear motivations to undertake actions that will remedy the situation. The case study concerning BCL appears to indicate that the problem is not with management of the firm. If there were gender or age discrimination then it is unlikely that Mary would have been employed as the safety officer in an industry that is predominantly male.
