it would be impossible to render a situation where educational facilities could be both separate and equal. It was decided that such a scenario represented a contradiction in terms. Another
less well known case, but also very important, is something that came forth in the 1990s and was the Supreme Court Case of Davis v. Monroe County Board of Education.
This case involved sexual harassment but it also was focused on the inability of a student to receive a fair education. Because of the torment LaShonda Davis received at the
hands of a fellow classmate, and the incompetent reaction of the school system, this students mother took the case to court. Not only was LaShonda not learning, she actually wanted
to die. This case goes beyond the boundaries of school walls and seeps into the psyche of a girl who was sexually harassed in a classroom. In the
content of the case, oral arguments were made on January 12, 1999 and opinions were provided on May 24, 1999 (Helberg, 2004). The primary question to emerge from this case
is as follows: " Can a school board be held responsible under Title IX of the Education Amendments of 1972, meant to secure equal access of students to educational benefits
and opportunities, for "student-on-student" harassment?" (The Oyez Project, 2008). The facts of the case demonstrate that the fifth grader who is at the crux of the matter, LaShonda Davis,
was sexually harassed. The outcome was rather dismal, but helped to make her case. She was in fact suicidal, and her grades were plummeting, all due to sexual comments made,
