The term "dangerous weapon" seems to be taking on new connotations all around the nation.
Part of the reason is the panic we are experiencing as a result of the threat of terrorism. Another part of the reason is relatively recent phenomena of school
violence. Some of our fear regarding weapons, of course, is justified. After all, its not hard to imagine what might be a seemingly innocent tool such as a
box cutter taking a completely different function in the hands of a terrorist. Just as frightening of an image is that of an assault weapon in the hands of
a youngster. In more than one recent incident, however, society seems to have allowed realistic fears to upgrade to unrealistic fears. Consequently, our common conceptions of what constitutes
a "dangerous weapon" have grown progressively more ludicrous. In most cases, of course, the legal definition of "dangerous weapon" differs significantly from those springing up in common usage.
This is particularly true when we consider certain incidents involving school age children who have been penalized for their possession of a "dangerous weapon".
The legal definition of "dangerous weapon" is pretty much consistent across states. In Maryland, the term "weapon" is reserved to those items that could cause bodily harm.
Maryland Criminal Law ? 4-101(a)(5)(i) specifically defines weapons as including: "a dirk knife, bowie
