In 2001, Ms. Dukes, with five other plaintiffs, filed a putative class action suit against Wal-Mart in the Ninth District Court of Appeals in Northern California,
alleging sex discrimination in the payment of wages and when it came to promotions (Wal-Mart Class Action Defense Case, 2008). Two years later, in April 2003, the plaintiffs moved to
certify a class-action suit on behalf of approximately 1.5 million former and present female employees at Wal-Mart of all classes (Wal-Mart Class Action Defense Case, 2008). Lawyers for the defense
argued that the requirements of Rule 23 (the rules under which class action status can be granted) (Wal-Mart Class Action Defense Case, 2008). Wal-Marts complaint involved the sheer size of
the class, arguing the problems inherent in a group of more than 1.5 million plaintiffs (Wal-Mart Class Action Defense Case, 2008).
The motion went to class action status because of the number of women employed at Wal-Mart who were undergoing similar complaints (Wal-Mart Class Action Defense Case, 2008). The suit involved
women employed at any Wal-Mart retail store in any capacity since late 1998, who might have been subjected to Wal-Marts "challenged pay" and promotions policies and practices (Wal-Mart Class Action
Defense Case, 2008). In 2004, the district rejected all but one of the defense arguments and certified the class action per
plaintiff request (Wal-Mart Class Action Defense Case, 2008). In 2007, following appeal by both sides, the Ninth Circuit again affirmed the class action request (Wal-Mart Class Action Defense Case, 2008).
