Supreme Court legislation does serve to undermine the intent of the 1964 Act, along with other federal laws, which relate to discrimination throughout the nation (Lassow, 2004). Disparate impact cases
in fact have cropped up in recent years. It seems that a discriminatory or disparate impact can come from any policy that is facially neutral (Mujahid-Moore, 2005).
That is, there is no intent to discriminate inherent in the policy but its implementation does have a discriminatory effect on members of a protected class (Mujahid-Moore, 2005).
When it seems that discrimination exists but is not easily recognizable they culminate in disparate impact cases (Zachary, 2003). What are these? It seems that disparate impact cases are aligned
with seemingly neutral employment practices and have a disproportionate impact on groups which are protected by employment discrimination statutes (Zachary, 2003). In such cases, there are no requirements that dictate
a plaintiff prove the defendant knowingly engaged in discriminatory behavior (Zachary, 2003). Rather, the point of the legislation is that any practice that might discriminate unintentionally is a disparate impact
case (Zachary, 2003). II. Disparate Impact Case Study The case Cuyahoga Falls v Buckeye Community Hope Foundation, focuses on a race-neutral policy, that if followed as prescribed, would
have a disproportionately negative impact on the housing possibilities as it relates to the African- American home seeker (Mujahid-Moore, 2005). The Buckeye Community Hope Foundation which is a nonprofit
developer, in 1995, bought six acres of property in Cuyahoga Falls ("Cuyahoga Falls," 2005). The foundation would submit a petition for approval to the city so an apartment building
