The author is correct in most of the statements s/he makes describing the bid system by which the government makes its purchase decisions
for big-ticket items. It is true that the law requires government agencies to extend bids for large items (specifically for contracts expected to be valued at more than $25,000),
and it is true that the law requires that the agency award contracts based on the lowest bid received. One feature of the
laws requirements that the author fails to note is that every agency not only has the right to assess bidders ability to meet the requirements of the contract, but that
each agency is required to make that assessment as part of the bid review process. No contractor will be seriously considered if it is unknown to the agency and
fails to provide evidence that it can provide the product that the agency seeks through the contract currently open to bid. This is
a quite reasonable approach to making the bidding process effective. The entire bid process already is time-consuming, delaying the agencys receipt of the item it seeks by means of
the bid process. The agency is required to release a Request for Proposals (RFP); advertise availability of the contract in the Commerce Business Daily; distribute RFPs to potential bidders
requesting one; allow time for contractor response; allow time for agency assessment of completed RFPs; and assess leading contractors apparent ability to produce the product the agency seeks.
