Real evidence "is a thing the existence or characteristics of which are relevant and material" (DiCarlo, 2001). Examples would be a written contract, the murder weapon, the blood on someones shirt. It is directly related to the case (DiCarlo, 2001). 2. Demonstrative evidence is something that illustrates a witnesss testimony and that accurately reflects that testimony. Examples could include maps, diagrams, animations (DiCarlo, 2001). The purpose of this type of evidence is to illustrate testimony, for example, a diagram of a street corner where a crime took place and where the witness was standing. Perhaps the greatest folly that was broadcast internationally was the O.J. Simpson trial when the prosecution insisted the defendant put on the gloves to prove they were his. The prosecutors failed to take into consideration things like clammy hands, the lining that had been placed in the gloves and Simpsons own ability to make the gloves look too small. Another problem in todays world is having the technology fail in the middle of a case. 3. Documentary evidence is sometimes a type of real evidence, such as a written contract that proves the terms of the agreement. This type of evidence is validated by a witness or sometimes by a chain of custody for the evidence (DiCarlo, 2001). There are even more challenges with documentary evidence in todays electronic world. One case that comes to mind is Microsoft. The Justice Department had significant problems trying to prove the origination of many e-mail messages and what they meant.
