Of course Frank was not obligated to answer police questions about his reasons for being present in another neighborhood, but it would have been expedient for him
to cooperate. It also would have saved much trouble for both him and the police, and would have reduced the intrusion into Franks seeking of internal peace.
The police also had a right to inquire as to Franks purposes. There is no indication that the police were harassing Frank in any
way, or doing anything else but following up on another citizens concerns. Franks chosen dress should not have been a factor in police decisions to pursue the matter.
On the other hand, Franks dress appeared to others as an anomaly, and the neighborhood had a history of anomalous activity. Part B
The local ordinance provides two conditions under which the police may not arrest a citizen. Frank met one of these conditions (providing identification), but he refused to account for
his presence. His failure to meet this condition technically gave the police the right to arrest him. Technical matters and practical ones
do not always perfectly align, however. Though the police had the right to arrest Frank and they needed to respond to the worried citizens concerns, they could have resolved
the matter simply and easily. This approach would have been greatly facilitated by Franks cooperation in explaining his presence, however. Another approach
the police could have taken would have been to examine Franks proof of identification and place of residence, followed by the realization that Franks residence was not far away.
