is crime?" and then examine specifically the topic of treason, terrorism and wartime criminal justice. This examination will show that the war on terrorism is an extremely complex subject, but
there are demonstrable differences between the instances in the past when constitutional rights, such as habeas corpus, have been suspended during previous wars and the factors defining the war on
terrorism, which is currently ongoing. What is Criminal Law? Overall, there are two main classifications within the criminal justice system: criminal law and civil law (Wright, et al,
2007). Criminal law refers to the "field of law that aims to protect society in general" and, therefore, focuses on the crimes of "murder, rape, theft and battery, as well
as white collar crimes such as fraud and embezzlement" (Wright, et al, 2007, p. 641). As this suggests, criminal law addresses malfeasance that has a negative effect on society as
a whole, rather than simply the individual (Wright, et al, 2007). Civil law addresses a broader range of malfeasance in that it pertains to the various areas in which
an individual may initiate a private lawsuit, that is, in regards to "contracts, injuries, real and personal property and family relations" (Wright, et al, 2007, p. 641). What is
