Governmental structure allows us as a society to define what is appropriate and what is inappropriate behavior as well as to define the
appropriate punishment for that behavior. Our multi-tiered government had provided both the definition and the means of enforcing the definitions of what constitutes inappropriate behavior and punishment. Criminal
justice policy is established both by the federal government and by the state. Although the state is most active in trying and sentencing criminals, it does so on the
basis of policies that have been jointly determined over time. Criminal justice policy is determined at a variety of levels in the criminal
justice system. The legislative divisions of the states and federal government are charged with making laws while the judicial divisions of these entities are charged with interpreting those laws
after they are passed. Courts of law exist at the local, state, and federal levels. The type of crime and
its specifics determine where it will be tried and there is a courtroom of some type in practically every county. It is these lower courts that hear civil, non-criminal
cases but these courts also hear criminal cases involving petty crimes to more serious cases like murder and armed robbery. Guilt or innocence in these courts can be declared
