in the justice system. The question posed by McGrath (2008) was: do appearances in the court have a deleterious effect on the offender? It has to do with labeling, i.e.,
contact with the court can stigmatize a person and this is counterproductive to changing behavior. What has been found is that when perpetrators are diverted into a good program,
it does tend to decrease future offenses. What is not known is whether the benefits of those diversions are independent of the court. They might be just as effective if
the perpetrator appeared in court. So far, studies have compared two groups, those who went through the court system and those who went into a diversion program. The two groups
were not matched, therefore, the effectiveness could relate to differences that existed prior to the court or program. McGrath compared several empirical research studies to determine if diversion reduces
recidivism. The program was the independent variable and recidivism was the dependent variable in all studies. In 2005, an empirical study was conducted among juvenile offenders (drugs or alcohol) which
included four groups. One group was a program called juvenile accountability which included community service, restitution, and assessment of their drug and alcohol history. The second group was a traditional
court that was supervised by the judge. Another group where sentences could be given that would include fines or warnings and finally, the control group. No differences were found between
groups. As McGrath says, conducting meta-analyses is difficult because not all studies include proper empirical methods and data. These and other studies included in his study suggest that diversion
