Britains criminal justice system is similar to Americas in more than only a few respects. The founding fathers patterned Americas legislative and judicial system after English common law,
providing the basis from which criminal activity would be defined and punished. Much of the nature of British criminal justice can be seen
in the fact that The Economist was able to publish complaints about government activity, specifically the violation of personal rights. The author asks, "What is a government to do
when faced with a bunch of undesirables whose guilt is difficult to prove in a court of justice" (Taking liberties, 2005; p. 10)? Britains solution to rising "anti-social behavior
- hellish neighbors, beggars, teenage gangs" (Taking liberties, 2005; p. 10) - has been to create additional legal tools. One of these newer tools is the anti-social behavior order
(ASBO), a creation born in large part from the increased terrorist activity and threats to developed nations. "ASBOs allow the police to bypass the normal procedures of criminal justice
when they suspect somebody of serious criminal activity but cannot prove it" (Taking liberties, 2005; p. 10). In years past, a reasonable observation
would be that such a thing would never happen in the US without great public outcry, but that was before passage of the Patriot Act. Passed six weeks after
the terrorist attacks of September 11, 2001, the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act (PATRIOT Act) likely is the most intrusive
