The lecture notes state that the plea bargain approach is used in 85 to 90 percent of cases moving through the judicial system. This allows prosecutors to
strike deals with accused individuals, deals in which the accused admits to guilt for some charge. The guilty plea usually is for a lesser charge than the original; the
benefit for the accused is that s/he generally will receive a lighter sentence for the lesser charge than for the original charge for which s/he will not undergo trial. Advantages
Advantages include saving "time, money and stress on the system" (Lecture notes, p. 4). The Constitution mandates that accused individuals be given
speedy trials, and clogged court calendars make it difficult to meet that requirement. Given that only 15 percent of cases actually go to trial, plea bargaining clearly prevents the
need for greatly expanding court capacities. For prosecutors to bring the accused to trial in a speedy manner should all criminal cases actually go to trial, most communities would
need many, many more courtrooms, judges, public defenders and support personnel. Operating costs would soar, and the added costs would be born directly by the taxpayers of the community.
Another advantage of plea bargaining is that it allows prosecutors to dispatch cases quickly, freeing time and resources to fully pursue more serious
or higher-profile cases. Further, it assures that a criminal is linked with a guilty plea. The trial process can be uncertain, and there is always a possibility that
